This Privacy Policy explains how FlyRecap LLC collects, uses, discloses, retains, and protects personal information when you use the FlyRecap application, website, accounts, subscriptions, and related services.

FlyRecap is designed around private flight-training reflection and controlled student-instructor sharing. We do not sell personal information, use it for cross-context behavioral advertising, or use voice recordings to create biometric voiceprints. Because recordings, transcripts, and training information can be sensitive, review the sharing controls carefully and record other people only with legally required permission.

1 Scope and Controller

This Policy applies to the FlyRecap mobile application, FlyRecap website, support, and related services (collectively, the Service). It applies to Students, CFIs, prospective users, and website visitors. It does not apply to third-party sites, services, flight schools, instructors, or organizations that process information under their own policies.

The Service is offered only to individuals located in the United States who are participating in or supporting U.S.-based flight training. It is not offered or directed to individuals outside the United States.

FlyRecap LLC is the controller or business responsible for the personal information described in this Policy, except when another party independently determines how it will use information it receives from you. FlyRecap is organized in Minnesota and may be contacted using Section 21.

This Policy is a disclosure of our practices and does not waive or limit rights that cannot be waived under applicable law. The Terms of Use govern use of the Service.

2 Information We Collect

2.1 Account and Profile Information

We collect the information needed to create, authenticate, recover, and administer your Account, including account role, age or age range where needed, and account status. Profile photos are stored privately and displayed only as the Service permits, such as to the user and Connected Users. If the Service lets a CFI enter certificate information, FlyRecap does not represent that the information is verified unless the interface expressly says so.

Passwords are managed by our authentication provider and are not available to FlyRecap in readable form. We may process authentication identifiers, recovery links or recovery events, session information, and security tokens needed to sign you in, reset a password, protect the Account, and prevent unauthorized access.

For a user age 16 or 17, the Account may remain pending or restricted until a parent or legal guardian completes FlyRecap's approval process. We may collect the guardian's name, email address, relationship to the user, approval or decline response, typed electronic signature, timestamps, and the versions of the Terms of Use, Privacy Policy, and consent form presented. We use this information to administer eligibility, document approval or withdrawal, activate or restrict the Account, and respond to support, privacy, security, or legal requests. Guardian approval information is not displayed to CFIs or other Connected Users.

2.2 Training and User Content

We collect information you enter, upload, record, import, receive, or create through the Service. Training content is not an official pilot logbook and should not be your only copy of required records, endorsements, authorizations, or other legally required aviation records.

A Connected User may provide information about you, including instructor feedback, skill status, lesson observations, voice notes, text, and amendments. We associate that content with the submitting user and the intended student or lesson.

Some convenience features may store limited information only on your device, such as a local Between Flights completion state or an unsent personal reminder, unless the interface indicates that the information is synced. Local-only information may not follow you to another device.

2.3 Information We Do Not Intend to Collect

FlyRecap does not need Social Security numbers, financial account credentials, medical records, health insurance information, or precise real-time location for its core features. Please do not include those items in recordings, notes, photos, reports, or support messages. If a recording incidentally contains sensitive information, it will be handled as User Content under this Policy, but you remain responsible for having authority to provide it.

FlyRecap does not use audio to create a voiceprint, identify a person by vocal characteristics, or authenticate an Account biometrically. Ordinary audio files and transcripts may still be personal information even though they are not used as biometric identifiers.

3 Sources of Information

  • From you. Registration, profile, permissions, recordings, imports, notes, training responses, milestones, support, and privacy requests.

  • From a parent or legal guardian. Contact, relationship, approval or decline, electronic-signature, and consent-record information submitted through the minor approval process.

  • From Connected Users. Invitations, CFI feedback, voice or text messages, shared training information, reports, and connection changes.

  • Automatically. Technical, usage, authentication, security, crash, and diagnostic events generated when the Service is used.

  • From platforms and providers. Subscription entitlements and limited transaction data from Apple, RevenueCat, or another billing provider; authentication and system events from our infrastructure providers.

  • Created by FlyRecap. Transcripts, summaries, milestone determinations, progress patterns, handoff summaries, and other outputs generated from the information above.

4 How We Use Information

We use personal information for the following purposes:

  • create, authenticate, recover, maintain, and secure Accounts;

  • determine age-based eligibility, send and administer parent or guardian approval requests, document approval or withdrawal, and activate or restrict Accounts for users age 16 or 17;

  • provide recording, import, transcription, recap, reflection, Between Flights, milestone, ACS progress, training-insight, connection, handoff, CFI feedback, notification, export, and subscription features;

  • sync and restore server-backed Account and training information across supported devices and reconcile local access with current server permissions;

  • display information to Connected Users only as directed or permitted by the applicable connection, sharing, handoff, or instructor feature;

  • identify shared recaps that may need instructor attention and surface recurring themes or progress supported by information the CFI is already authorized to view;

  • process purchases, verify entitlements, restore purchases, and administer paid access;

  • communicate about security, password recovery, account activity, feedback, connections, feature events, updates, and support;

  • process reports, enforce blocks, prevent blocked users from reconnecting through the Service, and investigate abuse, impersonation, harassment, fraud, unlawful recording, and security incidents;

  • personalize the Service using your training stage, preferences, and activity;

  • debug, maintain, analyze, and improve reliability, usability, accessibility, and product performance;

  • enforce the Terms of Use and protect FlyRecap, users, and others;

  • comply with law, legal process, tax, accounting, and regulatory obligations; and

  • create aggregate or deidentified information for analytics and product improvement, provided we do not attempt to reidentify it except to test our deidentification methods or as permitted by law.

Where applicable law requires a legal basis, we rely on performance of our contract with you, legitimate interests in operating and securing the Service, compliance with legal obligations, and consent for optional processing such as microphone access or AI processing where required.

5 Audio Transcription and Artificial Intelligence

When you use an audio, transcription, or AI-assisted feature, FlyRecap may collect or receive the audio or text and send the portion needed to a transcription or AI provider. The provider processes it on FlyRecap's behalf to return a transcript, summary, category, training insight, or other requested output.

Before personal information is sent to a third-party AI provider, FlyRecap will provide an in-app notice and obtain permission where required. If you decline microphone or AI processing permission, you may use any manual text alternative the Service makes available, but audio or automated features may not function.

We use business or API services and do not authorize providers to use FlyRecap Service Content to train their general-purpose models unless you separately and expressly opt in. Providers may retain limited content or metadata for security, abuse prevention, or legal compliance under their business terms. Authorized personnel may access content only when reasonably necessary for support, security, legal compliance, or quality control subject to confidentiality obligations.

AI and transcription outputs may be wrong. They do not determine legal rights or make decisions about solo eligibility, certification, checkride readiness, endorsements, employment, insurance, credit, housing, or another legal or similarly significant matter.

6 Student CFI Connections and Sharing

FlyRecap uses controlled connections and private sharing rather than public lesson posting. Where discovery or search is available, users may find limited profile information and send a connection request without already having an invitation. Discovery or a pending request does not grant access to private training content.

Progress and CFI Pulse informationStudent-facing progress may use the student's broader training history. CFI-facing pulse or insight information is limited to information the CFI is authorized to view, such as recaps shared with that CFI; a CFI does not receive access to private recaps merely because a pattern or progress feature exists.
Progress handoffVisible to the receiving CFI only as permitted by the handoff. A handoff does not include a prior CFI's name, avatar, user identifier, or raw voice recording. Prior instructor feedback included in a handoff is labeled generically, such as Prior CFI Feedback.
Reports and blocksReports are available to FlyRecap and service providers as needed for review and are not disclosed to the reported user except where necessary or required by law. Block status is used to enforce access and connection restrictions and is not a public profile field.
Subscription and payment detailsNot shared with Connected Users, except that the Service may show whether access is active when necessary to provide a feature.

Removing a connection, blocking a user, or otherwise revoking access stops future access as supported by the Service. On the next successful authenticated synchronization, CFI-facing cached data is intended to reconcile to current server permissions. Revoking access does not erase information a recipient already saw, exported, copied, or lawfully retained outside FlyRecap, and it does not erase delivered CFI feedback that forms part of the student's own training history. Users must not redistribute another person's private training content without authority.

7 Progress Handoffs Milestones and Inferences

FlyRecap may analyze lesson content, transcripts, CFI feedback, user-selected or CFI-confirmed skill statuses, and activity to create progress observations, milestones, recurring training themes, suggested focus areas, Between Flights activities, CFI Pulse indicators, or a continuity summary. Some milestones are created automatically from objective app events, while others are entered or confirmed by a user.

Between Flights may change the activity highlighted to a student according to calendar time since the most recent recap and the availability of real supporting data. It does not mean FlyRecap knows when the student's next flight or lesson is scheduled. CFI Pulse may surface new shared recaps, unanswered shared recaps, recurring themes, or progress based only on information the CFI is authorized to view.

ACS-related percentages, task statuses, and history are organizational training-progress features. Where a status is identified as CFI-confirmed, it reflects information submitted through the Service by an authorized CFI; it is not an FAA determination.

These outputs are inferences and organizational aids, not official evaluations. A label such as Meets ACS Standard reflects the input or criteria used in the Service and does not itself establish compliance with an Airman Certification Standard, legal proficiency, solo eligibility, endorsement, or checkride readiness.

We do not use these inferences for targeted advertising or for decisions producing legal or similarly significant effects. You may correct the underlying information where the Service permits, and generated outputs may change when the source data changes.

8 How We Disclose Information

We may disclose personal information in the following circumstances:

  • At your direction. To Connected Users or other recipients when you use a sharing, connection, export, or communication feature.

  • To service providers. To companies that perform hosting, authentication, private storage, transcription, AI, subscription management, crash reporting, notifications, email, support, security, or similar functions for FlyRecap.

  • For safety and integrity. When reasonably necessary to detect or respond to fraud, abuse, security threats, unlawful activity, violations of our Terms, or danger to a person.

  • For legal reasons. To comply with law, subpoena, court order, regulatory request, or other valid process; protect legal rights; or establish, exercise, or defend claims.

  • In a business transaction. In connection with due diligence, financing, merger, acquisition, reorganization, bankruptcy, receivership, or sale of assets, subject to confidentiality and applicable notice obligations.

  • With professional advisers. To attorneys, accountants, auditors, insurers, and similar advisers bound by duties of confidentiality.

  • In aggregate or deidentified form. For product, research, business, or reporting purposes where the information cannot reasonably be linked to an individual.

We do not make private lesson content public. We may disclose information to a flight school, employer, or organization only when the user directs the disclosure, the organization is a Connected User or account administrator under a clearly identified feature, or disclosure is otherwise lawful.

9 Service Providers

Providers used by FlyRecap may include:

  • Supabase for authentication, databases, backend services, and private file storage;

  • OpenAI or another disclosed AI or transcription provider for transcription, summarization, categorization, and related AI-assisted features;

  • RevenueCat for subscription entitlement and purchase-management services;

  • Apple for App Store distribution, purchases, billing, subscription administration, and platform services; and

  • Infrastructure and operations providers for email, notifications, analytics, crash reporting, customer support, security, and hosting as the Service develops.

Providers receive only the information reasonably necessary for their functions and are required by contract or applicable terms to protect it and process it for authorized purposes. Providers may process information in the United States or other locations where they or their subprocessors operate. We will update this Policy when a new provider materially changes how personal information is processed.

10 Sale Targeted Advertising and Profiling

FlyRecap does not sell personal information for money or other valuable consideration and does not share personal information for cross-context behavioral advertising as those terms are defined under applicable U.S. state privacy laws. We do not use third-party advertising networks in the Service and do not allow analytics providers to build cross-app or cross-site advertising profiles from FlyRecap data.

FlyRecap does not profile users in furtherance of decisions that produce legal or similarly significant effects. If these practices change, we will update this Policy, provide required notice, and offer required opt-out or consent controls before the new practice begins.

11 Device Permissions Cookies and Similar Technologies

11.1 Microphone Photos and Notifications

FlyRecap requests microphone access only when needed to record audio. It may request camera or photo-library access when you choose to add or change a profile photo or import supported content. It may request notification permission to alert you about account, connection, feedback, subscription, or training events. You can change these permissions in device settings, but disabling them may limit the related feature.

11.2 Cookies SDKs and Diagnostics

The website and app may use essential cookies, local storage, SDKs, and similar technologies for authentication, security, preferences, entitlement verification, diagnostics, and analytics. We do not use these technologies for third-party behavioral advertising. Browser Do Not Track signals do not have a single legal or technical standard; where law requires recognition of a universal opt-out signal, we honor a valid signal for the covered processing. Because we do not sell or share data for targeted advertising, such a signal generally does not change current practices.

11.3 Local Storage Sync and Caches

FlyRecap may keep encrypted or access-controlled local copies, sync metadata, downloaded audio, or other cached data on a device so the Service can load efficiently or continue limited functionality during temporary network interruptions. Server-backed Account information may be restored or merged when you sign in on a supported device. Some convenience information may remain device-only when the interface indicates or the feature is designed that way.

Server authorization is authoritative for Connected User access. After a successful synchronization shows that a CFI or other Connected User no longer has permission to view certain content, FlyRecap is designed to remove that content from the app's authorized local view or cache on that user's device. Copies independently exported outside FlyRecap are not controlled by this synchronization.

12 Data Retention

We retain personal information only as long as reasonably necessary for the purposes described in this Policy, including providing the Service, maintaining user-directed training history, resolving disputes, protecting security, enforcing blocks, reviewing reports, and satisfying legal, tax, accounting, and contractual obligations. Retention depends on the type of information, your settings, whether the Account remains active, whether the information forms part of another user's independent training record, and legal or technical requirements.

Failed or temporary uploads may be kept briefly for retry and troubleshooting.
Delivered CFI feedback text transcripts statuses and amendmentsMay remain with the intended student's training history after disconnection or deletion of the CFI Account so the student can retain training continuity. The deleted CFI's identity may be removed or replaced with a generic Former CFI label. This retained content is used only for the student's record, authorized handoffs, security, disputes, or legal obligations.
Raw CFI voice feedbackMay be retained while needed to provide playback and according to the applicable audio-retention settings, but may be deleted during the CFI's account deletion or later retention cycle. Removing raw voice does not necessarily remove the delivered text or transcript from the student's training history.
HandoffsFor the active handoff period and any limited period reasonably necessary for access control, integrity, security, dispute resolution, or legal obligations. Handoffs do not include prior-CFI identity information and may continue to contain deidentified Prior CFI Feedback even if that prior CFI deletes an Account.
Connection block and sharing recordsWhile needed to manage access, prevent blocked reconnection, preserve the integrity of training history, respond to disputes, and document security-relevant events.
Reports and moderation recordsFor as long as reasonably necessary to review and resolve the report, detect repeat abuse or fraud, protect users, enforce the Terms, and meet legal obligations.
Local-only Between Flights completion or personal remindersMay remain only on the device until the app is removed, local data is cleared, or the feature replaces the information. Local-only information may not be restored on another device.
Subscription transactionsFor the period required to administer entitlements and satisfy tax, accounting, fraud-prevention, and legal obligations.
Security logs and diagnosticsFor a limited period reasonably necessary to secure, troubleshoot, and improve the Service, then deleted or aggregated unless needed for an incident or legal obligation.
Support privacy and legal requestsFor as long as needed to respond, document compliance, resolve disputes, and meet recordkeeping obligations.
BackupsDeleted information may persist temporarily in restricted backups until overwritten under the backup cycle and is not restored to active use except for disaster recovery or security needs.

Local cached copies may exist on a device to support playback, sync, or performance. FlyRecap is designed to clear protected audio caches at sign-out and Account deletion and to reconcile CFI-visible caches after authorization changes, but exported files, device backups, screenshots, and copies outside FlyRecap remain under the control of the device owner or third party.

13 Account Deletion and Content Deletion

You may initiate Account deletion through the in-app deletion control, currently located in Settings under Legal and Privacy, or by contacting hello@flyrecap.com. We begin processing verified deletion requests promptly and ordinarily complete deletion from active systems within 30 days, unless additional time or retention is reasonably necessary and permitted by law.

13.1 Student Account Deletion

Student Account deletion is intended to remove or deidentify the student's Account, profile, owned training content, stored student audio, server-backed reminders, connections, and related personal information from active systems. CFI feedback delivered into that student's training history is generally removed with the student's record, except to the extent a limited copy must be retained for another user's independent record, security, dispute resolution, legal process, or another permitted reason.

13.2 CFI Account Deletion

CFI Account deletion is intended to remove or deidentify the CFI's Account, profile, authentication information, avatar, active connections, and other CFI-owned personal information from active systems. However, CFI feedback that was already delivered to a student may remain as part of that student's independent training history so the student does not lose training continuity merely because the instructor leaves FlyRecap.

When delivered feedback is retained after CFI Account deletion, FlyRecap may remove the former CFI's name, user identifier, avatar, and other unnecessary identifying information and display the source generically as Former CFI. The substantive feedback text, transcript, date, skill-status information, and amendments may remain where needed for the student's record. Raw CFI voice recordings may be deleted during account deletion or according to the applicable audio-retention cycle even when the text or transcript remains.

A valid student-controlled handoff does not depend on the prior CFI keeping an Account. If preserved prior feedback is included in a handoff, the receiving CFI sees it generically as Prior CFI Feedback; the handoff does not include the prior CFI's name, user identifier, avatar, or raw voice recording.

13.3 Deletion Exceptions

Some information may remain after an Account deletion request when:

  • a recipient already received or exported it;

  • it forms part of another user's independent record and law or the Service relationship permits retention, in which case we limit the retained information and may remove identifiers;

  • it is needed to maintain a valid deidentified handoff or training-continuity record;

  • it is held in a restricted backup awaiting overwrite;

  • retention is necessary for security, fraud prevention, enforcing a block, reviewing an abuse report, tax, accounting, legal process, dispute resolution, or enforcement; or

  • the information is aggregated or deidentified so it is no longer reasonably linked to you.

Deleting a FlyRecap Account does not cancel an App Store or other externally billed subscription. Cancel the subscription separately through the billing provider. Deleting the app from a device does not delete the Account.

14 Your Privacy Rights and Choices

Depending on where you live and subject to legal exceptions, you may have the right to:

  • confirm whether we process personal information and access categories or copies of it;

  • correct inaccurate personal information;

  • delete personal information, subject to permitted retention such as deidentified Delivered CFI Feedback that forms part of another user's independent training history;

  • obtain information you provided in a portable format where technically feasible;

  • obtain a list of specific third parties to which personal information was disclosed where applicable law requires it;

  • opt out of sale, targeted advertising, or qualifying profiling;

  • withdraw consent for future optional processing;

  • use available connection, block, report, notification, audio, and sharing controls;

  • appeal a refusal to act on a request; and

  • exercise rights without unlawful discrimination or retaliation.

Use available in-app settings or email hello@flyrecap.com with the subject Privacy Request. Identify the right you want to exercise and the Account email. We may verify identity using information already associated with the Account and may deny or limit a request where we cannot verify it or an exception applies. An authorized agent may submit a request where law permits, subject to proof of authority and identity verification.

For a user age 16 or 17, a parent or legal guardian may also contact hello@flyrecap.com to withdraw approval, request review or correction of guardian approval information, or assist with a privacy request, subject to reasonable identity and relationship verification and the teen user's rights under applicable law. Withdrawing approval may require restriction, suspension, or deletion of the teen user's Account, subject to Section 13 and permitted retention.

Where applicable, we respond within 45 days and may extend once when reasonably necessary after providing notice. Requests are generally free, although law may allow a reasonable charge or denial for manifestly unfounded, excessive, or repetitive requests.

To appeal, email hello@flyrecap.com with the subject Privacy Appeal within a reasonable period after our response. Include the original request and why you believe the decision should change. We will respond within the period required by applicable law and explain how to contact the appropriate regulator or state attorney general if the appeal is denied.

15 U S State Privacy Disclosures

U.S. state privacy laws apply only when their scope and thresholds are met. FlyRecap may voluntarily honor reasonable access, correction, deletion, and portability requests even when a particular law does not require it.

For Minnesota residents, the Minnesota Consumer Data Privacy Act provides qualifying consumers with rights that may include access to categories, correction, deletion, portability, opt-out rights, information about qualifying profiling, and a list of specific third parties. The statute generally applies only after specified processing or revenue thresholds and includes a small-business exclusion, but Section 14 describes how to submit a request regardless.

FlyRecap does not currently sell personal information, share it for cross-context behavioral advertising, use it for targeted advertising, or conduct qualifying profiling. Therefore, there is no current sale, sharing, targeted-advertising, or significant-decision profiling activity to opt out of. If that changes, we will add required controls before beginning the activity.

16 California Notice at Collection

For California residents, the table below summarizes the categories of personal information collected during the preceding 12 months, the purposes, and categories of recipients. We have not sold or shared any category for cross-context behavioral advertising during that period. We do not use or disclose sensitive personal information for purposes that require a right to limit under California law.

California residents may request to know, correct, delete, or obtain a portable copy of qualifying information and may use an authorized agent. We do not discriminate for exercising rights. California Shine the Light: we do not disclose personal information to third parties for their own direct marketing purposes.

17 Children and Teen Users

FlyRecap is intended only for users age 16 and older. Users under 16 may not create or use a FlyRecap Account. We do not knowingly permit or maintain Accounts for users under 16. If we learn that an under-16 user created an Account or that we collected personal information from such a user contrary to this Policy, we will take reasonable steps to restrict or deactivate the Account and delete or deidentify the information as appropriate, subject to limited retention permitted or required by law.

Users age 16 or 17 may use FlyRecap only after a parent or legal guardian completes the approval process provided by the Service. FlyRecap generally uses an age range rather than an exact birth date where the Service allows. Until parent or guardian approval is completed, the Account may remain pending or restricted and may not use recording, training-content, connection, communication, or other protected features.

FlyRecap may send a secure approval request to the parent or legal guardian email provided for a 16- or 17-year-old user. The approval process may request the guardian's name, email address, relationship to the user, required confirmations, typed full name as an electronic signature, and an approval or decline response. We record the response, date and time, and the versions of the Terms of Use, Privacy Policy, and consent form presented so that we can administer and document the authorization.

Parent or guardian approval information is not shown to CFIs or other Connected Users. A parent or legal guardian may withdraw approval by contacting hello@flyrecap.com. Withdrawal may require restriction, suspension, or deletion of the teen user's Account. We may retain limited approval records as described in Section 12 when reasonably necessary for security, dispute resolution, or legal or contractual recordkeeping.

We do not sell or share minors' personal information for targeted advertising and do not use teen data for decisions producing legal or similarly significant effects. If you believe a user under 16 is using FlyRecap, contact us promptly at hello@flyrecap.com.

18 Security

FlyRecap uses administrative, technical, and organizational safeguards designed to protect personal information. Depending on the system, these may include authenticated access, encrypted network transmission, private object storage, access-control and database authorization rules, least-privilege practices, protected secrets, logging, password-recovery controls, server-authoritative sharing permissions, and deletion or reconciliation of protected local caches when an Account signs out, is deleted, or loses access after a successful synchronization.

No method of transmission, synchronization, authentication, or storage is completely secure. You are responsible for protecting your credentials, recovery links, and device, installing updates, reviewing recipients before sharing, and keeping exports secure. Notify us promptly at hello@flyrecap.com if you suspect unauthorized access or disclosure.

19 United States Only Service

FlyRecap is based in the United States and is intended solely for individuals located in the United States who are participating in or supporting U.S.-based flight training. FlyRecap is not offered or directed to individuals outside the United States.

Personal information is primarily processed in the United States. Certain service providers or their personnel may process information from other locations where they operate, subject to their contractual confidentiality, security, and data-protection obligations.

If FlyRecap expands outside the United States, we will update this Policy and implement any additional notices, contractual safeguards, representatives, consent mechanisms, or other measures required before offering the Service in those locations.

20 Changes to This Policy

We may update this Policy as the Service, providers, or law changes. We will post the updated Policy and revise the date above. If a change materially affects how we use previously collected personal information, we will provide additional notice and obtain consent where required before applying the change. We encourage you to review the Policy when the Service changes.

These Terms are a binding agreement between you and FlyRecap LLC governing your access to and use of the FlyRecap mobile application, website, accounts, subscriptions, and related services.

PLEASE READ THESE TERMS CAREFULLY. SECTION 29 REQUIRES MOST U.S. DISPUTES TO BE RESOLVED THROUGH INDIVIDUAL BINDING ARBITRATION, INCLUDES A CLASS ACTION WAIVER, AND EXPLAINS HOW TO OPT OUT WITHIN 30 DAYS.

By creating an account, purchasing a subscription, accessing the Service, or selecting an acceptance control, you agree to these Terms and acknowledge the Privacy Policy. If you do not agree, do not use the Service.

1 Definitions

  • Account means the credentials and profile used to access the Service.

  • CFI means a user who accesses instructor-side features, whether or not FlyRecap has independently verified that person's certificate or ratings.

  • Connected User means a student, CFI, or other permitted user linked through a FlyRecap connection or accepted relationship.

  • Delivered CFI Feedback means text, transcript, voice-derived content, skill status, amendment, or other feedback a CFI intentionally sends through FlyRecap to an identified student.

  • Handoff means a student-controlled continuity summary or package made available to a receiving CFI through a FlyRecap handoff feature.

  • Service means the FlyRecap application, website, accounts, subscriptions, software, features, content, and related support operated by FlyRecap LLC.

  • Student means a user accessing student-side features for any certificate, rating, endorsement, proficiency goal, or stage of flight training.

  • User Content means recordings, transcripts, notes, profile information, photographs, responses, feedback, files, training information, reports, messages, and other material submitted to or created through the Service by a user.

  • FlyRecap means FlyRecap LLC, also referred to as we, us, or our.

2 Eligibility and Authority

You must be at least 16 years old to create or use a FlyRecap Account. Users under 16 may not create or use an Account or the Service.

If you are 16 or 17 years old, FlyRecap requires approval from a parent or legal guardian through the approval process provided by the Service before your Account may be activated for normal use. Until that approval is completed, your Account may remain pending or restricted, and you may not use recording, training-content, connection, communication, or other protected features.

FlyRecap may send the parent or legal guardian a secure approval request and may collect the guardian information and consent record described in the Privacy Policy. The parent or legal guardian must provide accurate information and represent that they are authorized to act for the 16- or 17-year-old user.

By approving a 16- or 17-year-old user's Account, the parent or legal guardian authorizes the minor to use FlyRecap, acknowledges the Privacy Policy, and agrees to these Terms on their own behalf and, to the extent permitted by applicable law, on behalf of the minor. The parent or legal guardian agrees to supervise the minor's use and may be responsible for that use to the extent permitted by law.

A parent or legal guardian may withdraw approval by contacting hello@flyrecap.com. Withdrawal may require FlyRecap to restrict, suspend, or delete the minor's Account, subject to the Privacy Policy and any retention permitted or required by law. FlyRecap may require renewed parent or guardian approval if reasonably necessary because of a material change to the Service, these Terms, the Privacy Policy, or applicable requirements.

If you use FlyRecap for or on behalf of a flight school, employer, club, organization, or other entity, you represent that you have authority to bind that entity to these Terms. If you lack that authority, you may use the Service only in your individual capacity.

FlyRecap is offered solely to individuals located in the United States for use in connection with U.S.-based flight training. The Service is not offered or directed to persons outside the United States. You may not access or use the Service where doing so would violate applicable law.

You may not use the Service if applicable law prohibits you from doing so, if your Account has been suspended or terminated for a material violation, or if you are subject to trade restrictions described in Section 32.

3 What FlyRecap Provides

FlyRecap is a flight-training organization, reflection, communication, continuity, and progress-awareness tool. Depending on the features available to your Account, FlyRecap may let users record or import lesson audio, create transcripts and recaps, answer post-lesson questions, review Between Flights activities, organize training information, track milestones and ACS-related skill development, connect with instructors, exchange text or voice feedback, surface shared-recap insights for instructors, prepare a progress handoff, sync supported Account data across devices, recover account access, report or block users, and export selected content.

FlyRecap is a technology provider. It is not a flight school, flight instructor, designated pilot examiner, airman certification authority, aircraft operator, dispatcher, mechanic, weather provider, navigation service, emergency service, or aviation safety authority. FlyRecap does not supervise flight operations or create a professional relationship between FlyRecap and any user.

4 Account Types and Training Stages

FlyRecap may offer Student and CFI account experiences. Student status includes people training for a private pilot certificate, instrument rating, commercial pilot certificate, flight instructor certificate, instrument flight instructor rating, or another certificate, rating, endorsement, or proficiency goal supported by the Service.

A user training for a CFI or CFII credential remains a Student for student-side subscription and feature purposes. Holding a pilot or instructor certificate does not convert that person's own training use into free instructor-side use. CFI-side access may be offered without charge when used to support connected students, but FlyRecap may change eligibility, features, or pricing prospectively with notice where required.

Account labels are for product access and organization only. They do not constitute verification of identity, certificate status, currency, qualification, employment, or authority unless FlyRecap expressly states that a particular verification has been completed.

Unless the interface expressly states that FlyRecap has verified a credential, a CFI designation, certificate number, rating, school affiliation, or other aviation credential is self-reported by the user and has not been independently verified by FlyRecap. Users should independently verify instructor identity and qualifications through appropriate official records or documentation before relying on a person for flight instruction.

5 Accounts and Security

  • Provide accurate, current, and complete registration information and keep it updated.

  • If the Service asks for age, parent, or guardian information, provide accurate information and do not bypass, falsify, or misuse the age or parent or guardian approval process.

  • Use only your own Account and do not share passwords, authentication codes, recovery links, or access tokens.

  • Keep your device, email account, and login credentials secure and notify us promptly of suspected unauthorized access.

  • Do not impersonate another person or misstate aviation credentials, ratings, training relationships, or affiliation.

  • You are responsible for activity through your Account to the extent caused by your acts or omissions. You are not responsible for activity caused solely by a security failure attributable to FlyRecap.

We may require email verification, password recovery, reauthentication, or other reasonable steps before changing sensitive account information, exporting data, or processing a privacy request. Recovery links are sensitive credentials and should not be shared.

6 Student and Instructor Relationships

Students choose whether to connect with an instructor, subject to the discovery, request, connection, block, and sharing controls available in the Service. A user may be able to discover limited profile information and send a connection request without a prior invitation. Discovery or a pending request does not grant access to private training content.

Users are responsible for confirming the identity, certificate status, ratings, currency, authority, and suitability of any person with whom they train or exchange information. Do not rely solely on a FlyRecap role label, profile, connection, or feedback history as proof that a user is a certificated or current flight instructor.

CFIs remain independently responsible for the instruction, supervision, endorsements, recordkeeping, aeronautical decision-making, and professional duties they undertake. FlyRecap does not direct the manner or method of instruction and is not responsible for the acts, omissions, advice, availability, or qualifications of any user.

A connection in FlyRecap is not proof of an employment, agency, partnership, school enrollment, or instructor-student relationship, and does not itself authorize flight, solo privileges, endorsements, or access to aircraft.

A user may block another user where the feature is available. An active block may end or restrict an existing FlyRecap connection and prevent new connection requests or reconnection until the block is removed. Blocking does not erase historical training content that the blocking user is otherwise entitled to retain.

7 Recording and Consent

The Service may permit audio recording and import. Recording laws vary by location and may require the consent of every person recorded. Before recording, you must provide any legally required notice and obtain all legally required permission from every participant. You may not secretly or unlawfully record any person.

You are responsible for the location where recording occurs, the people present, the content captured, and compliance with applicable wiretap, eavesdropping, privacy, employment, school, and aviation rules. FlyRecap does not determine whether a proposed recording is lawful.

Do not record radio communications, cockpit conversations, passengers, minors, customers, employees, or other people unless you are authorized to do so. Stop recording when consent is withdrawn or when continuing would violate law, safety, policy, or another person's rights.

8 Lesson Content and User Content

You retain ownership of your original User Content. You grant FlyRecap a worldwide, nonexclusive, limited, royalty-free license to host, store, reproduce, format, transmit, transcribe, analyze, summarize, display, sync, restore, and otherwise process User Content only as reasonably necessary to operate, secure, support, and improve the Service; provide features you request; comply with law; and enforce these Terms. This license includes using service providers acting on FlyRecap's behalf.

When you direct FlyRecap to share User Content with a Connected User, you also authorize FlyRecap to make that content available to the recipient and allow the recipient to view, play, download, or use it as the feature permits. A recipient may retain information already viewed or exported even after access is revoked.

If you are a CFI, you understand that Delivered CFI Feedback is intentionally delivered into the student's training history. You authorize FlyRecap to preserve the substantive text, transcript, skill-status information, date, and amendments of Delivered CFI Feedback in the intended student's record for training continuity even after you disconnect from the student or delete your CFI Account, subject to the Privacy Policy. If your Account is deleted, FlyRecap may remove your identifying information and display the source as Former CFI. This surviving license is limited to operating the student's training-history, handoff, security, dispute, and legal functions and does not authorize unrelated use of your feedback.

You represent that you own or have all rights, permissions, and lawful bases needed to submit and process User Content. Do not submit Social Security numbers, financial account credentials, medical records, export-controlled technical data, legally privileged material, or other highly sensitive information unless the Service specifically requests it and you are authorized to provide it.

FlyRecap may remove or restrict User Content that violates these Terms, creates a legal or security risk, or is subject to a valid legal request. FlyRecap does not assume a general duty to monitor private User Content.

9 Sharing Connections and Progress Handoffs

FlyRecap is designed to make training continuity easier, but access is controlled by the Service's current connection and sharing model. Connecting with, reconnecting with, or switching instructors may make specified profile, lesson, progress, skill-status, recap, transcript, or feedback information available to the connected instructor only as the applicable feature permits.

A Handoff is controlled by the student and may be assembled from User Content, prior shared recaps, Delivered CFI Feedback, training-stage information, skill or ACS-related progress, and automated analysis. It may be incomplete, outdated, or inaccurate. Students and instructors must review the underlying records and discuss the student's current status directly before relying on a Handoff.

A Handoff does not identify a prior CFI. It must not include the prior CFI's name, display name, user identifier, avatar, or raw voice recording. Relevant prior feedback may be included as text or transcript under a generic label such as Prior CFI Feedback, together with the lesson date or training context needed for continuity.

A valid Handoff does not depend on the prior CFI maintaining a FlyRecap Account. If a prior CFI deletes an Account before or after the Handoff is created, preserved deidentified feedback may remain available to the student and receiving CFI as permitted by the Handoff.

Original student audio is private unless the student uses a feature that expressly shares it. Sharing a transcript does not necessarily share its source audio.

Disconnecting or blocking a user stops future access as the Service provides, but does not require the recipient to forget information already seen or delete lawful copies previously exported outside FlyRecap. If a recipient misuses information, use available report or block controls and contact us.

10 Instructor Feedback and Communications

Connected CFIs may send text, voice, transcription, skill-status, progress, amendments, or other feedback to a student. That feedback is the statement of the submitting user, not FlyRecap. FlyRecap does not adopt, certify, guarantee, or independently validate it.

A student may not alter the substance of CFI-authored feedback in a way that falsely attributes different words or conclusions to the CFI. FlyRecap may display an automated transcript of voice feedback, which can contain errors. While raw audio is retained and available, the audio may be the better source for what was spoken.

Once CFI feedback has been delivered to the intended student, it may form part of that student's training history. A CFI's later disconnection, block, suspension, or Account deletion does not necessarily remove the substantive delivered text, transcript, skill-status information, date, or amendments from the student's record. When the CFI Account is deleted, FlyRecap may deidentify the author as Former CFI and may remove raw voice according to the Privacy Policy while preserving the text or transcript for continuity.

No in-app comment, rating, progress label, ACS-related status, feedback item, CFI Pulse indicator, or training insight is an FAA endorsement, logbook entry, training record, solo authorization, practical-test recommendation, or other formal certification unless it independently satisfies all applicable legal requirements and the responsible CFI intentionally executes it in an authorized form.

11 Transcription Artificial Intelligence and Automated Content

FlyRecap may use automated systems and third-party artificial intelligence or transcription providers to produce transcripts, summaries, suggested categories, progress observations, skill trends, reminders, or other generated content. By enabling an AI or transcription feature after receiving the applicable notice, you direct FlyRecap to send the necessary content to the provider for that purpose.

Automated content can omit context, misidentify speakers, misunderstand aviation terminology, infer the wrong maneuver or standard, or otherwise be inaccurate. You must review generated content before saving, sharing, or relying on it. FlyRecap does not use automated output to legally determine solo eligibility, proficiency, checkride readiness, endorsements, certification, employment, insurance eligibility, or another decision producing a legal or similarly significant effect.

You may not use FlyRecap's generated content as a substitute for live instruction, current regulations, official publications, approved aircraft documentation, weather, NOTAMs, or sound aeronautical decision-making.

12 Progress Indicators Milestones and Training Insights

The Service may display milestones, lesson counts, skill bars, ACS-related statuses, progress percentages, recurring training themes, Between Flights activities, CFI Pulse indicators, trend statements, or encouragement based on User Content and activity. These features are motivational, organizational, and continuity tools. They are not official assessments and do not establish that a user meets an Airman Certification Standard or any other regulatory standard.

Where the Service identifies an ACS status as CFI-confirmed, it means an authorized CFI explicitly submitted or confirmed that status through FlyRecap. Automated analysis, artificial intelligence, recap patterns, milestones, student self-report, or other generated content may not independently set, advance, or promote a CFI-confirmed ACS status, including Meets ACS Standard. A CFI-confirmed status does not mean FlyRecap or the FAA independently verified proficiency, and it does not replace the CFI's legal judgment, endorsements, or required records.

Between Flights may highlight different review activities according to calendar time since the student's most recent recap and the availability of real supporting data. FlyRecap does not manage flight scheduling and does not know when a student's next flight or lesson will occur unless a future feature expressly states otherwise.

CFI Pulse may identify shared recaps that have not received feedback, recurring topics in recaps shared with that CFI, or progress supported by content the CFI is authorized to view. It does not score or rank students and does not give a CFI access to private recaps merely because an insight feature exists.

A milestone may be created automatically from data in FlyRecap or entered by a user. Users must not claim a solo, endorsement, rating, flight time, certificate, or other accomplishment they did not earn. FlyRecap may correct or remove a milestone when the supporting data is changed or when the milestone is inaccurate or misleading.

Progress can be nonlinear and depends on factors FlyRecap cannot observe. No metric, bar, percentage, comparison, featured activity, or trend guarantees a training outcome, reduces required instruction, or authorizes a user to attempt a maneuver or flight.

13 Imports Exports and Device Copies

If FlyRecap allows file or audio import, you are responsible for confirming that the file is lawful, safe, compatible, and yours to use. Imported content may be processed like other User Content. Exported files leave FlyRecap's controlled environment and may be stored, copied, backed up, or shared by you or your device provider.

Server-backed Account information may sync or restore across supported devices. FlyRecap may merge local and server records to reduce duplication and preserve newer or unsynced content. Some convenience information may remain device-only and may not follow you to another device. Temporary network failures may delay synchronization.

You are responsible for protecting exports and local copies. Deleting content from FlyRecap may not delete copies stored in device backups, downloads, email, cloud drives, another user's device, or other systems outside FlyRecap's control. FlyRecap is not an official pilot logbook or a substitute for maintaining required records independently.

14 Aviation Safety and Regulatory Disclaimer

YOU REMAIN SOLELY RESPONSIBLE FOR CONDUCTING ALL FLIGHT AND GROUND OPERATIONS SAFELY AND LEGALLY.

FlyRecap does not and cannot:

  • provide flight instruction or replace a certificated and appropriately rated instructor;

  • determine proficiency, currency, aeronautical experience, eligibility to solo, or readiness for a knowledge or practical test;

  • issue or authenticate FAA endorsements, certificates, ratings, authorizations, logbook entries, or required records;

  • replace an official pilot logbook or any record required by applicable aviation law;

  • provide operational control, dispatch, flight following, navigation, collision avoidance, aircraft control, emergency assistance, or air traffic services;

  • replace official weather, aeronautical information, NOTAMs, charts, regulations, Airworthiness Directives, aircraft performance data, weight and balance calculations, or an aircraft's approved POH, AFM, limitations, procedures, and checklists; or

  • guarantee safety, certification, checkride success, regulatory compliance, training cost savings, or any learning outcome.

Never use or interact with FlyRecap when doing so would distract from safe aircraft operation. Do not delay, disregard, or override an instructor's direction, air traffic control instruction, aircraft limitation, approved procedure, legal requirement, or safety decision because of anything displayed by FlyRecap. The Service is not intended for emergency or in-flight safety-critical use.

15 Subscriptions Trials Billing and Refunds

Certain Student features may require a paid auto-renewable subscription. CFI-side features may be offered without charge, while a CFI or CFII student using student-side training features may require a paid Student subscription. Before a purchase is authorized, the applicable purchase screen or billing provider presents the material transaction terms, which may include the price, billing period, automatic-renewal terms, trial or promotional conversion terms, cancellation information, and included features. Prices are not fixed by these Terms. A subscription is charged only after the user affirmatively authorizes the transaction through the applicable billing provider.

  • Automatic renewal. An auto-renewable subscription continues for successive billing periods until canceled in accordance with the deadline and process disclosed by the applicable billing provider. The billing provider charges the payment method associated with that account.

  • Trials and promotions. Eligibility may be limited. Unless canceled before the stated deadline, a trial may convert to a paid subscription. Promotional offers may have additional terms.

  • Cancellation. Manage and cancel an App Store subscription through your Apple Account subscription settings or the applicable billing provider using the cancellation method made available by that provider. FlyRecap will not require a separate cancellation process for an App Store-billed subscription. Deleting the app or your FlyRecap Account does not automatically cancel an externally billed subscription.

  • Refunds. Refunds for purchases processed by Apple or another platform are governed by that platform's rules and applicable law. FlyRecap cannot guarantee or directly issue a refund for a transaction controlled by a third-party platform.

  • Price changes. A price change applies only as permitted by the billing provider and applicable law, with any notice or consent required by that provider or law.

  • Taxes and currency. Displayed prices may exclude taxes and may vary by storefront, location, currency, or platform.

  • Entitlements. Subscription access depends on a valid entitlement from the billing provider. Use Restore Purchases or contact us if a completed purchase is not recognized.

We may change free features or offer different plans prospectively. We will not charge you a new or higher recurring price without the notice or consent required by law and the applicable billing platform.

16 Acceptable Use

You may not use or attempt to use the Service to:

  • violate law, regulation, court order, aviation rule, or the rights of another person;

  • record, upload, disclose, or distribute content without required authority or consent;

  • harass, threaten, stalk, exploit, discriminate against, defame, or impersonate another person;

  • misrepresent a certificate, rating, endorsement, qualification, identity, training event, milestone, or professional relationship;

  • access another user's Account or private content without authorization, or defeat connection, sharing, or access controls;

  • upload malware, corrupted files, unlawful content, or material that infringes intellectual property, privacy, publicity, confidentiality, or contractual rights;

  • probe, scan, overload, disrupt, bypass, or interfere with the Service, its security, or another user's experience;

  • scrape, harvest, crawl, bulk export, resell, sublicense, or commercially exploit the Service or its data except through an expressly authorized feature;

  • reverse engineer, decompile, disassemble, or attempt to derive source code except to the limited extent applicable law prohibits this restriction;

  • use automated systems or AI to build a competing product from FlyRecap content or to train a model on content you do not have the right to use;

  • use the Service for surveillance, emergency response, in-flight control, dispatch, navigation, or another safety-critical purpose; or

  • encourage or assist any prohibited conduct.

17 Reporting Blocking and Moderation

Users may report another user or relevant User Content through available in-app controls or by contacting hello@flyrecap.com. A report may include a reason, optional explanation, and references needed to locate the reported Account or content. Reports are confidential to the extent practical and are not ordinarily disclosed to the reported user except when necessary to investigate, enforce these Terms, protect safety, or comply with law.

Users may block another user where the feature is available. Blocking may end or restrict an active connection, prevent new connection requests or reconnection while the block remains active, and revoke future access to private content according to the Service's authorization rules. Blocking does not erase historical Delivered CFI Feedback from the student's own training history merely because the former CFI is blocked.

We may investigate reports, preserve relevant records, restrict or remove content, enforce blocks, suspend connections, suspend or terminate Accounts, or take other reasonable action. We do not guarantee a particular outcome, disclose confidential investigative details, or resolve private training, employment, payment, or interpersonal disputes between users.

You may not misuse reporting or blocking tools to harass another user, submit knowingly false reports, evade enforcement, or interfere with another user's lawful use of the Service.

18 Ownership and Limited License

FlyRecap and its licensors own the Service, including its software, interface, workflows, design, branding, logos, databases, documentation, and non-user content. Subject to these Terms, FlyRecap grants you a personal, limited, revocable, nonexclusive, nontransferable, nonsublicensable license to access and use the Service for its intended purposes on devices you own or control and as permitted by the applicable app marketplace.

Except for this limited license, no intellectual property rights are transferred. You may not use FlyRecap names, marks, or branding without written permission, except for truthful reference to the Service consistent with law.

19 Feedback to FlyRecap

If you send ideas, suggestions, or product feedback to FlyRecap, you grant FlyRecap a worldwide, perpetual, irrevocable, royalty-free right to use and incorporate that feedback without restriction or compensation. This does not give FlyRecap ownership of your private lesson content or personal information.

20 Third Party Services and Terms

The Service may depend on app stores, authentication, cloud hosting, transcription, AI, subscription management, analytics, crash reporting, email, notification, or other third-party services. Your use of those services may be subject to their terms and privacy policies. You must comply with applicable third-party terms, including wireless data, device, and app marketplace agreements.

FlyRecap is not responsible for third-party services outside its control, and those services may change or become unavailable. Links do not imply endorsement. Nothing in these Terms expands a third party's responsibility beyond its own agreement with you.

21 Copyright Complaints and Counter-Notices

If you believe material available through FlyRecap infringes your copyright, send a written notice to the copyright contact in Section 35 or, if FlyRecap has designated an agent under 17 U.S.C. Section 512, to the current designated-agent contact information published by FlyRecap and registered with the U.S. Copyright Office. A notice should include: a physical or electronic signature of the copyright owner or authorized agent; identification of the copyrighted work claimed to be infringed, or a representative list when appropriate; identification and location of the allegedly infringing material sufficient for FlyRecap to locate it; contact information for the complaining party; a statement of good-faith belief that the challenged use is not authorized by the copyright owner, its agent, or the law; and a statement under penalty of perjury that the information is accurate and that the complaining party is authorized to act.

When FlyRecap removes or disables access to material in response to a qualifying copyright notice, we may take reasonable steps to notify the user who supplied the material. If that user believes the material was removed or disabled because of mistake or misidentification, the user may submit a written counter-notice to the same copyright contact or designated agent.

A counter-notice should include: the user's physical or electronic signature; identification of the material removed or disabled and the location where it appeared before removal; a statement under penalty of perjury that the user has a good-faith belief the material was removed or disabled because of mistake or misidentification; and the user's name, address, and telephone number, together with the jurisdiction and service-of-process statements required by 17 U.S.C. Section 512(g).

After a valid counter-notice is received, FlyRecap may restore the material in the time required by applicable law unless the original complaining party timely notifies FlyRecap that it has filed an action seeking a court order concerning the material. FlyRecap may adopt and reasonably implement a policy for terminating repeat infringers where appropriate.

A person who knowingly makes a material misrepresentation in a copyright notice or counter-notice may be liable under applicable law. Nothing in this Section requires FlyRecap to restore content removed for a reason independent of copyright, including a violation of these Terms, safety, privacy, or security concerns.

22 Privacy and Security

The FlyRecap Privacy Policy explains how personal information is collected, used, disclosed, retained, and protected. It is incorporated by reference for informational and contractual purposes to the extent permitted by law. You agree to use other users' information only for the training and communication purpose for which it was made available and to protect it from unauthorized use or disclosure.

No internet-connected service is completely secure. You should maintain your own appropriate records and backups and promptly report a suspected security issue to hello@flyrecap.com. Do not publicly disclose a vulnerability before giving us a reasonable opportunity to investigate and address it.

User Content may document a chronology of training, including a student's own statements, instructor feedback, recordings, transcripts, and progress information. Although FlyRecap is not an official pilot logbook or FAA record, such content may be preserved, requested, or disclosed when required or permitted by valid legal process, a litigation hold, or the establishment, exercise, or defense of legal claims, as described in the Privacy Policy.

23 Service Availability and Changes

FlyRecap is under active development. We may add, modify, suspend, limit, or discontinue features, integrations, storage, plans, or the Service. We may perform maintenance or respond to security, legal, technical, or business needs. We do not guarantee uninterrupted, error-free, or perpetual availability, compatibility with every device, or preservation of every item of User Content.

If we discontinue a paid Service before the end of a prepaid period, we will provide any remedy required by applicable law or the billing provider. You should export important content when an export feature is available and maintain any official records independently.

24 Suspension Termination and Account Deletion

You may stop using the Service at any time and may request Account deletion through the in-app deletion control or by contacting us. Account deletion and subscription cancellation are separate actions.

24.1 Student Account Deletion

Deleting a Student Account is intended to remove or deidentify the student's Account, profile, server-backed training history, stored student audio, active connections, and related personal information from active systems, subject to the Privacy Policy, backups, another user's independent records, security, dispute, and legal-retention exceptions.

24.2 CFI Account Deletion

Deleting a CFI Account is intended to remove or deidentify the CFI's Account, profile, authentication information, avatar, active connections, and other CFI-owned personal information. It does not require FlyRecap to erase substantive Delivered CFI Feedback that has already become part of the intended student's training history.

After CFI Account deletion, the student's record may retain the delivered feedback text, transcript, date, skill-status information, and amendments, while the former CFI's identity is removed or replaced with Former CFI. Raw CFI voice may be removed according to the Privacy Policy. Preserved deidentified feedback may continue to appear in a valid student-controlled Handoff as Prior CFI Feedback, without identifying the former CFI.

24.3 Suspension and Other Termination

We may restrict, suspend, or terminate access, connections, or content when reasonably necessary to address fraud, abuse, unlawful conduct, a security threat, nonpayment, material breach, risk to users or third parties, or discontinuation of the Service. When practicable and legally permitted, we will provide notice and a reasonable opportunity to cure before terminating for a remediable breach.

We may also terminate an Account or discontinue access to all or part of the Service for legitimate business, operational, technical, legal, or product reasons that are not based on user misconduct. When practicable and legally required, we will provide reasonable advance notice. If such a termination ends paid access before the end of a prepaid period, we will provide any refund, continued access, or other remedy required by applicable law or the billing provider.

On termination, your license ends. Sections that by their nature should survive will survive, including the limited permissions needed to preserve Delivered CFI Feedback in a student's training history, ownership, permissions needed to complete deletion and backups, disclaimers, liability limits, indemnification, dispute terms, and general provisions. The Privacy Policy describes deletion and retention in more detail.

25 Disclaimers of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED AS IS AND AS AVAILABLE. FLYRECAP DISCLAIMS ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, QUIET ENJOYMENT, ACCURACY, AND COURSE OF DEALING.

FlyRecap does not warrant that the Service or any transcript, summary, progress status, ACS-related status, CFI Pulse indicator, handoff, cloud synchronization or restore, instructor feedback, notification, export, or other content will be accurate, complete, current, secure, available, or free from interruption, loss, or harmful components. FlyRecap does not warrant any aviation, education, certification, safety, employment, financial, or cost-savings outcome. Some jurisdictions do not allow certain disclaimers, so some of this Section may not apply to you.

26 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FLYRECAP LLC AND ITS MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, CONTRACTORS, AFFILIATES, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOST PROFITS, REVENUE, SAVINGS, BUSINESS, GOODWILL, OR DATA; COST OF SUBSTITUTE SERVICES; OR PERSONAL INJURY, PROPERTY DAMAGE, AIRCRAFT DAMAGE, REGULATORY CONSEQUENCES, OR OTHER LOSS ARISING FROM RELIANCE ON OR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL AGGREGATE LIABILITY OF FLYRECAP AND THE OTHER FLYRECAP PARTIES FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO FLYRECAP FOR THE SERVICE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY; OR (B) US $100.

These limitations apply regardless of the legal theory and even if a remedy fails of its essential purpose. They do not limit liability that cannot lawfully be limited, including liability for fraud, willful misconduct, or other nonwaivable rights where applicable. Your payment provider's obligations are governed separately.

27 Indemnification

To the extent permitted by law, you will defend, indemnify, and hold harmless the FlyRecap parties from claims, damages, judgments, losses, liabilities, costs, and reasonable attorneys' fees arising out of or relating to: your User Content; your unlawful recording or disclosure; your violation of these Terms, law, or another person's rights; your misrepresentation of credentials or training status; or your unsafe or unauthorized use of the Service. This obligation does not apply to the extent a claim results from FlyRecap's own negligence, willful misconduct, or violation of law.

FlyRecap may control the defense of a covered claim, and you agree to cooperate. You may not settle a claim in a manner that admits wrongdoing by or imposes obligations on FlyRecap without written consent.

28 Release Regarding Other Users

To the maximum extent permitted by law, FlyRecap is not responsible for disputes between users or for the acts, omissions, instruction, statements, credentials, or content of another user. You release the FlyRecap parties from claims arising solely from your dealings with another user, except to the extent caused by FlyRecap's own breach of duty or where a release is prohibited by law.

29 Dispute Resolution Arbitration and Class Action Waiver

THIS SECTION AFFECTS YOUR LEGAL RIGHTS. IT REQUIRES INDIVIDUAL ARBITRATION OF MOST DISPUTES AND PROHIBITS CLASS OR REPRESENTATIVE PROCEEDINGS, UNLESS YOU TIMELY OPT OUT.

29.1 Informal Resolution First

Before starting arbitration or a lawsuit, the claimant must send a written Notice of Dispute to the other party and allow 60 days for informal resolution. A notice to FlyRecap must be sent by email to hello@flyrecap.com with the subject Dispute Notice and by mail to the address in Section 35. It must include the claimant's name, account email, contact information, facts, legal basis, and requested relief. Any limitations period is tolled during the 60-day period where permitted by law.

29.2 Agreement to Arbitrate

If a dispute is not resolved informally, you and FlyRecap agree that any claim arising out of or relating to these Terms, the Privacy Policy, or the Service will be resolved by binding individual arbitration administered by the American Arbitration Association under its then-current Consumer Arbitration Rules, except as stated below. The Federal Arbitration Act governs this arbitration agreement. If the AAA is unavailable and the parties cannot agree on an alternative, a court may appoint an arbitrator under 9 U.S.C. Section 5.

The arbitrator may award the same individual relief a court could award and must follow applicable substantive law. The arbitrator may decide issues concerning the scope, enforceability, or formation of this arbitration agreement, except that a court will decide any issue concerning the class action waiver. Hearings may occur by telephone, video, documents, or in person as the rules permit. FlyRecap will pay arbitration fees to the extent required by the AAA rules or applicable law.

29.3 Exceptions

Either party may bring an individual action in small claims court if it remains within that court's jurisdiction. Either party may seek temporary or preliminary injunctive relief in court to prevent imminent unauthorized access, security abuse, or infringement or misappropriation of intellectual property while arbitration is pending. Nothing in this Section prevents a user from reporting an issue to a government agency or seeking public injunctive relief where a waiver is prohibited by law.

29.4 Class Action and Jury Trial Waiver

YOU AND FLYRECAP WAIVE THE RIGHT TO A JURY TRIAL AND AGREE THAT EACH MAY BRING CLAIMS ONLY IN AN INDIVIDUAL CAPACITY, NOT AS A PLAINTIFF OR CLASS MEMBER IN A CLASS, COLLECTIVE, CONSOLIDATED, PRIVATE ATTORNEY GENERAL, OR REPRESENTATIVE PROCEEDING. THE ARBITRATOR MAY NOT CONSOLIDATE CLAIMS OR PRESIDE OVER A REPRESENTATIVE PROCEEDING WITHOUT THE WRITTEN CONSENT OF ALL PARTIES.

29.5 Opt Out

You may opt out of this arbitration agreement by emailing hello@flyrecap.com within 30 days after the date you first accept these Terms. Use the subject Arbitration Opt Out and include your full name, Account email, and a clear statement that you opt out of arbitration. Opting out will not affect your Account or other Terms. An opt-out applies only to the person and Account identified and does not reject the remainder of these Terms. For an Account holder age 16 or 17, the parent or legal guardian who completed the approval process may submit the opt-out on the minor's behalf to the extent permitted by law.

29.6 Severability

If a portion of this arbitration agreement is unenforceable, it will be severed and the remainder enforced, except that if the class action waiver is unenforceable as to a particular claim or request for relief, that claim or request will proceed in court after any arbitrable portions are completed.

30 Governing Law and Court Venue

These Terms are governed by the Federal Arbitration Act and, for matters not governed by federal law, the laws of Minnesota without regard to conflict-of-law principles. If a dispute is not subject to arbitration, the parties consent to exclusive jurisdiction in an appropriate state court in Minnesota or the United States District Court for the District of Minnesota, except where applicable consumer law requires another forum.

31 Apple App Store Terms

If you download FlyRecap through Apple's App Store, the following terms apply in addition to these Terms. The license to the downloaded application is governed by Apple's Standard Licensed Application End User License Agreement unless FlyRecap posts a valid custom EULA in App Store Connect. To the extent these Terms address the online Service rather than the application license, these Terms also apply; Apple's standard EULA controls any conflict concerning the application license.

  • These Terms are between you and FlyRecap, not Apple. FlyRecap, not Apple, is responsible for the Service and its content.

  • Apple has no obligation to provide maintenance or support for FlyRecap. Contact FlyRecap at the address or email in Section 35.

  • To the extent a warranty exists and the application fails to conform, you may notify Apple for any refund Apple is required to provide. To the maximum extent permitted by law, Apple has no other warranty obligation.

  • FlyRecap, not Apple, is responsible for addressing claims relating to the application or your possession or use of it, including product-liability, legal-compliance, consumer-protection, and privacy claims.

  • FlyRecap, not Apple, is responsible for investigating, defending, settling, and discharging claims that the application infringes third-party intellectual property rights.

  • You must comply with applicable third-party terms when using the application.

  • Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce the Apple-specific provisions against you.

32 Export Controls and Sanctions

You represent that you are not located in a country or region subject to a comprehensive U.S. government embargo or designated by the U.S. government as supporting terrorism, and that you are not listed on a U.S. government restricted-party list. You will not export, reexport, or transfer the Service or related technology in violation of U.S. export-control or sanctions law.

33 Changes to These Terms

We may update these Terms as the Service, law, or our practices change. We will post the updated Terms and revise the date above. If a change materially reduces your rights or increases your obligations, we will provide reasonable advance notice through the Service, email, or another appropriate method where required. Changes apply prospectively unless law permits otherwise.

If you do not agree to updated Terms, you must stop using the Service and cancel any subscription. Continued use after the effective date constitutes acceptance where permitted by law. A change to the arbitration provision will not apply to a claim for which a valid Notice of Dispute was received before the change took effect. For an Account holder age 16 or 17, FlyRecap may require renewed parent or legal guardian approval before continued use after a material change.

34 General Provisions

  • Entire agreement. These Terms, the Privacy Policy, purchase terms shown at checkout, and any additional terms presented for a specific feature form the entire agreement concerning the Service.

  • Order of precedence. Specific feature or purchase terms control over these Terms for that subject. Apple's standard EULA controls the iOS application license as stated in Section 31.

  • Severability. If a provision is unenforceable, it will be modified to the minimum extent necessary or severed, and the remainder will continue.

  • No waiver. Failure to enforce a provision is not a waiver.

  • Assignment. You may not assign these Terms without written consent. FlyRecap may assign them in connection with a merger, financing, reorganization, sale of assets, or by operation of law, subject to applicable law.

  • No agency. These Terms do not create employment, agency, partnership, joint venture, fiduciary, or franchise relationships.

  • Electronic communications. You consent to receive agreements, notices, receipts, and service communications electronically. Marketing messages, if any, are subject to separate choices and law.

  • Force majeure. FlyRecap is not liable for delay or failure caused by events beyond reasonable control, including natural disasters, internet or utility failures, labor disputes, government action, cyberattack, or third-party service interruption.

  • Headings. Headings are for convenience and do not limit interpretation.
